Davis Bacon Prevailing Wage

In the United States we have a law that is made by the federal government. We call it the Davis-Bacon act.
The Davis-Bacon act is the law that sets the standard wages on federal construction projects such as federal buildings, roads, military construction, Bridges, freeways and highways etc. So far there are 29 states that have passed a law that sets the minimum construction rate for projects in their state. These laws usually cover state funded projects as opposed to federal funded projects. These state wage recommendations are updated on a regular basis. And usually they are updated by county.

Many people around the country rely on Davis-Bacon and a state prevailing wage laws sometimes known as little Davis bacon   for their livelihood and these members push-back when states try to change the laws so that these skilled crafts people make less money. On a yearly basis the building trades unions spend time on Capitol Hill meeting with senators and congressmen and women to explain to them how prevailing wage works for the benefit of the taxpayers.

Many cheap contractors want to do away with prevailing wage both Davis-Bacon and state prevailing wages.
They may try to use an argument that "more can be constructed if labor rates are cheaper."  The fallacy in this argument is that when you pay cheaper wages for less skilled crafts people, you don’t get more built, in fact, you get less built and with lower quality.  When lobbyists try to get rid of federal Davis-Bacon laws they are in-turn getting rid of good jobs and turning them into low-wage jobs with no benefits. If you look around the country at the contractors who pay low wages with no benefits, you will see longer construction times and lower quality workmanship. They have been doing this for so long now, a quick Google search will show you that many states and many contractors are begging for more construction workers around the country. They have pushed so many people out of the construction industry that now they are having a hard time finding more people to enter the construction industry. The other problem is that because they have cut wages so low across the country, they can no longer afford apprenticeship programs and therefore the skilled labor is disappearing as well. It seems that anti-Davis-Bacon legislation pushed by Low-Road contractors has created a problem for those same contractors. Meanwhile there are many people around the Country who would be happy to go to work for those contractors if they could make a living wage. They are sitting on the sidelines waiting for us to push legislation in their favor so that they can earn a decent living with benefits. It is incumbent upon us to do just that.
Davis-Bacon prevailing wage must survive and must make a rebound if we are to save our construction industry.
By standing up for Davis-Bacon prevailing wage and for state prevailing wage survey laws we will help the constituents of our local economies to start careers in construction and to graduate from apprenticeships. taxpayers can be proud that their dollars are going to build expertise in construction and allow fathers and mothers to raise their children on a living wage. These dollars will reverberate throughout the community helping small businesses to prosper and helping families pay for college tuition for children. By cutting the cost of labor, this hurts apprenticeships across-the-board and in a short time will cost the taxpayers money in the form of low quality workmanship and unskilled labor. We need to stop the treadmill of who can build lower on construction projects and instead look at who can build best. Let’s not put our skilled crafts people that we have spent so much time and effort training out of work in exchange for lower skilled workers. You get what you pay for in construction.
Construction workers deserve adequate compensation and benefits and paying adequate compensation is not an over-expenditure but instead an investment.
 When we invest these dollars not only are we getting a terrific looking project but we are building the future construction workers of our communities through apprenticeships and investing in our own economies when these workers cash and spend their paychecks in our communities. Businesses prosper and business people prosper. They then re-spend their earnings in our communities as well. We should be competing on quality of work. Prevailing wage jobs that promote apprenticeships also help to minimize the number of construction accidents and deaths because construction workers are being trained with those dollars as well. This cuts back on the cost of the project when we can use these trained workers on the next project as well. We should not have to retrain all of our workers on every project. We carry that value forward as well as the skilled craftsmanship.
Contractors are always looking for a way to trim their bids, but cutting workers wages should not be a part of that.
If we continue to do this, the next contractor will cut wages even more in order to get a bid and so on down the line until workers are left with No other option than to find work elsewhere. This is where we find ourselves in many states were construction companies say they cannot find enough workers. It’s not that they can’t find enough workers, it’s that they can’t find enough workers for the low wages that they want to pay. So as we move forward in building our nations infrastructure we should keep in mind and build it the right way with skilled workers who earn good wages. Don’t let state lawmakers consider bills that would cut our wages and benefits. Retain Davis-Bacon laws across the country and reinstate prevailing wage laws in states that have repealed them and are now having difficulty finding skilled craft  people to work on their projects. Doing this, best people will return to the apprenticeship classes and soon skilled craftsmen and women will be back on the job earning family living wages and creating projects that we can be proud of.

Unions have legal representation and are able to stand up for employees rights when they are being mistreated. Many times I have seen were unions have been able to help employees file unfair labor practices, sue for payment, sue for benefit payment, and other scenarios where employers have cheated workers from money or benefits that are owed to them. Unions can also petition private companies and public entities to pay Family living wages and benefits for employees and in this way are able to represent both union and non union craftworkers by making a way for them to earn better wages and benefits.


Union work places are safer. One good thing about unions is that they usually make agreements with their signatory contractors to pay a small amount of money into apprenticeship programs. These programs then are able to pay for Apprentice training, journeyman upgrade training, and also safety training. The contractors want employees who are highly skilled who are safe and craft workers who can make money for the contractor without costing the contractor a lot of money in medical and insurance costs. Most unions teach their apprentices and journeyman OSHA 10 and OSHA 30 training which is 10 and 30 hours of safety training ending in those workers receiving a card showing that they have fulfilled all of the requirements to pass the OSHA 10 hour OSHA 30 class that was prepared by the occupational safety and health administration. This helps the contractor to avoid costly injuries and deaths on job sites, citations from Osha inspectors, and paves the way for lower insurance bills if they can prove that they are a safer contractor than the average. Oh contractors are looking for an edge and if you can get lower insurance rates then you can bid lower and thus you can gain more marketshare and be a more profitable contractor.


Unions fight for equal pay and equal opportunities on their work places. These days we are hearing a lot of the double standard between wages for men and women. The good thing about trade unions is that their wages for apprentices and journeyman are written in the contract. The contract also states that there will be no toleration for discrimination. Men and women alike make the same amount of money if they are journeyman. Also because of the language in the contract that calls for non-discrimination, there really is no discrimination on the work place between races. I will also add that many unions are actively seeking more women to apply to work in the trades. Unions like the fact that more and more often women are choosing to become a premises and journey out and become great employees for the contractors as well. Some even take it further and become contractors themselves. Some of the best union contractors we work for are owned by women.


Unions can help you find a job. So you’re working on a job site and you’ve been there for six months and the outlook is that the job will last another six months, but what do you do after that? You know you’re going to get laid off when the job is over unless you get lucky and the contractor has another job lined up. Sometimes they do. Many union employees work for the same company all the time year after year job after job. But typically the way union contractors work is they hire mini union workers when there’s a lot of work and then went to work slows down, they get laid off. The union may be able to help those workers find a different contractor to work for if there is a lot of work and many contractors that are signatory to the union. Don’t get me wrong you can still call buddies and contractors and ask if they need help but it’s always nice to have the union looking for work for you as well. My union has a list that you sign when you were laid off. This lets other contractors know that you are available. We have a 2 to 1 ratio were contractors can read your name on the list and call you out by name. They can do this for two workers and then they have to take the first person on the out of work list. Then they can go back and request to more again by name and so forth. The list continues to move in if you don’t get called off by name eventually make your way to the top of the list and you were sent out on the next call. If the call last less than three days you stay at the top of the list and go out again. If you are a good worker and you have made a name for yourself you usually stay pretty busy. I can only think of one time when I was concerned after I was laid off but I ended up going to work after three days. Almost the rest of my career I was always working. Mostly for the same contractor but once in a while I would have to take a job with another contractor as mine was out of work. The beauty of it is that we keep our same benefit plan and our same retirement plan. It also gives you time between jobs to do journeyman upgrade classes get more certifications and make yourself more marketable. It’s a good deal for everyone including the contractors.

OPCMIA local 577 Denver completed OSHA 10 training for their cement masons today. #getyousomeunion

The plasterers and cement masons union in Denver Colorado local 577 finished the second day of their two day training of OSHA 10 for construction. This is a two day safety training class that was designed by the Occupational Safety and Health Administration to train the workforce to learn to recognize job site hazards and correct them making for a safer workplace. This group of guys was fun to be with as we did our training. Questions were asked and as a group we discussed possible answers and outcomes. There are several parts of the OSHA 10 training for construction including an introduction to OSHA and focus four hazard training including falls, electrocution hazard‘s, caught in between hazards, and struck by hazards. There were several other topics we covered and at the end of the second day the guys felt like they learned a lot and knew better how to be safe on the job site. Now they can take pride in being more knowledgeable about safety issues. Good job guys.
